Mental Capacity Act 2005

This Act protects people who might struggle to make decisions whilst respecting everyone's right to choice. It starts with presumption of capacity - you're assumed able to make decisions unless proven otherwise.

The Act supports people to make their own decisions by requiring all practicable help before assuming someone lacks capacity. Crucially, you can't be treated as lacking capacity just because others disagree with your unwise decisions.

When someone genuinely can't decide, any action must be in their best interests using the less restrictive option that interferes least with their rights. This protects vulnerable people whilst maintaining their dignity and autonomy.

Important: Making unusual choices doesn't mean you lack capacity - everyone has the right to make decisions others might think are wrong!
