Understanding Statutory Interpretation

You've probably noticed that laws don't always make perfect sense in every situation. That's where statutory interpretation comes in - it's how judges work out what Parliament intended when they passed an Act.

There are several reasons why this becomes necessary. Drafting errors happen when Parliamentary draftsmen make mistakes in the original bill. Unforeseen events occur when medical and technology advances aren't covered by existing Acts - imagine trying to apply old "vehicle" laws to skateboards that didn't exist when the law was written!

Broad terms and ambiguity also create headaches. Laws often use generic words with multiple meanings, like the Disability Discrimination Act 1995, which had to be interpreted in various situations. The classic example is how "vehicle" laws had to adapt when skateboards were invented long after the original legislation.
