Law's Role in Society and the Rule of Law
Law serves four key functions that keep society ticking along smoothly. It protects us from harm, settles disputes when things go wrong, provides essential services like healthcare and education, and tries to nudge people towards doing the right thing whilst deterring bad behaviour.
Lord Bingham's Rule of Law sets out eight principles for how law should work fairly. The big ideas include making laws clear and accessible to everyone, ensuring nobody gets punished unless they've actually broken a law, and guaranteeing equal treatment regardless of background. Courts should be affordable and accessible, with cases heard without ridiculous delays.
But here's the reality check - these principles often fall short. Laws can be confusing and inaccessible, especially after legal aid cuts and court closures. Wealthy people still have better chances in court, and miscarriages of justice like Derek Bentley's case show the system isn't foolproof.
Key Point: The gap between legal theory and practice means justice isn't always as fair as it should be, particularly affecting those who can't afford top legal representation.
Society's Influence on Law
Media campaigns massively influence lawmaking, often leading to knee-jerk reactions from Parliament. Sarah's Law emerged from media pressure to identify paedophiles, whilst the Dangerous Dogs Act 1991 rushed through after high-profile dog attacks - yet it's destroyed thousands of healthy dogs whilst people still die from attacks by non-banned breeds.
Social control happens in two ways: informally through family and community pressure, and formally through Parliament, police, and courts. The jury system embodies this idea of being judged by your peers, but there's a massive problem - magistrates are overwhelmingly white (89%), over 50 (86%), and middle-class, hardly representing the young, diverse defendants they're judging.
Public opinion shapes legal changes, like allowing homeowners to use force that's less than "grossly disproportionate" when defending their property after the Tony Martin case. However, this balancing act between individual and state interests creates constant tension - your right to privacy versus national security concerns.
Reality Check: We live in an increasingly litigious culture where everyone's ready to sue, costing the NHS £1.3bn in compensation in 2014-15 alone and driving up everyone's insurance premiums.
