Understanding Fraud by False Representation for BTEC Law Students
Elements of Fraud by False Representation
Fraud by false representation under Section 2 of the Fraud Act 2006 might sound complicated, but it's actually quite straightforward once you break it down. The law requires three main elements: a false representation, dishonesty, and intention to make gain or cause loss.
Let's look at Harry's case - he told Anna that stolen software plans were his own work and promised to develop software for £20,000, knowing full well he'd just buy a car instead. This gives us a perfect example of how the offence works in practice.
The representation itself can be about facts, someone's state of mind, or even legal matters. Harry's lies were both about facts (claiming the plans were his) and his state of mind (pretending he intended to develop software). The key case DPP v Ray shows how lying about your intentions counts as fraud.
Quick Tip: Remember that representations can be expressed (spoken or written) or implied (suggested through actions). Harry explicitly told Anna lies, making this expressed representation.
Proving Dishonesty and Intent
The prosecution must prove the defendant knew their statement was false. Section 2(2)(b) makes this easier by including situations where someone knows their representation "might be" untrue or misleading - you don't need absolute certainty.
Dishonesty is tested using the standard from R v Barton: would an ordinary honest person with the same knowledge think the defendant's conduct was dishonest? This is brilliant because it reflects community standards rather than just legal technicalities.
The final element requires intention to make gain or cause loss. The Fraud Act defines this broadly - gain includes keeping what you have or getting something new, whilst loss covers both losing what you have and missing out on potential benefits. Harry gained £20,000 and a car, whilst Anna lost her money and missed out on the promised software.
Remember: This is a triable either way offence with a maximum sentence of 10 years imprisonment, showing how seriously the law takes this type of dishonest behaviour.
The main weakness in the law is that "false" isn't clearly defined in the statute, which can lead to inconsistent jury decisions in borderline cases.
