Understanding Automatism as a Defence
Automatism kicks in when someone commits a crime but their muscles acted "without any control by the mind" - essentially, they weren't conscious of what they were doing. This isn't just feeling a bit spaced out; it's about having zero mental control over your actions.
There are two main types you need to know. Insane automatism happens when the cause is internal (like a mental disease), which actually leads to an insanity defence rather than automatism. Non-insane automatism occurs when something external triggers the loss of control - this is the one that can get you completely off the hook.
When automatism works, it's brilliant for the defendant because it's a complete defence. The prosecution can't prove the actus reus (the guilty act) was voluntary, and the defendant lacks the required mens rea (guilty mind) because of their automatic state.
Key Point: For automatism to succeed, the loss of control must be total - partial loss of control simply won't cut it in court.
Self-Induced Automatism and Key Cases
Here's where it gets tricky - self-induced automatism has different rules depending on whether you're charged with a specific intent crime (like murder) or a basic intent crime (like assault). If you knowingly did something that led to your automatic state, you might lose this defence entirely.
The courts look at two main scenarios where self-induced automatism fails: when you've been reckless in becoming an automaton, or when illegal drugs/drinks caused your state. However, if you genuinely didn't know your actions would lead to automatism, you might still have a defence.
R v Bailey shows how being reckless destroys your defence - a diabetic who didn't eat after taking insulin couldn't use automatism because he should have known better. But R v Hardie demonstrates the opposite: taking Valium that had unexpected effects allowed the defence to succeed because the defendant couldn't predict the outcome.
Remember: The key question is always whether you could reasonably have foreseen that your actions would lead to an automatic state.
