Anglo-Saxon England (1000-1066): Community-Based Justice

Back in Anglo-Saxon times, dealing with crime was very much a community affair. Theft, murder, assault, and moral crimes like adultery were the main offences, with treason and arson being super serious.

The hue and cry system meant that if you witnessed a crime, the whole village had to drop what they were doing to help catch the criminal. Tithings were groups of 10 men who were responsible for each other's behaviour - if one person committed a crime, the others were in trouble too.

When evidence was lacking, they used trial by ordeal - religious tests like holding hot iron or being dunked in cold water. The idea was that God would decide if you were guilty or innocent. Wergild was compensation money paid to victims' families, with the amount depending on social status.

Key Point: Anglo-Saxon justice focused on community responsibility and religious trials, with compensation rather than harsh punishment.

Norman England (1066-1154): Royal Control Takes Over

William I didn't mess about when it came to controlling his new kingdom. He introduced harsh new laws to keep the Anglo-Saxons in line and show who was boss.

The murdrum fine was particularly brutal - if a Norman was killed, the whole Saxon village had to pay up unless they found the actual killer. Forest laws made hunting or cutting trees in royal forests illegal, though ordinary people saw these as "social crimes" and often ignored them.

The Normans kept some Anglo-Saxon traditions like tithings and hue and cry, but made punishments much harsher. Trial by combat was introduced, and there was way more capital punishment and mutilation. Wergild started disappearing, replaced by executions and fines paid directly to the king.

Key Point: Norman rule brought royal authority into crime and punishment, with much harsher consequences to intimidate the conquered population.

Later Medieval England Part 1 (1154-1300): Royal Courts Develop

This period saw massive changes in how trials worked, moving away from community-based justice towards royal control. Henry II's Assize of Clarendon in 1166 was a game-changer, setting up royal judges and circuit courts that travelled around the country.

Grand juries were introduced to investigate and report crimes, whilst trial by jury slowly started replacing the old trial by ordeal system. When the Pope banned trial by ordeal in 1215, jury trials became the standard way of deciding guilt.

The Church's influence grew stronger during this time. Church courts dealt with heresy, moral offences, and crimes by clergy. Benefit of clergy allowed anyone who could read (or memorise) Psalm 51 to claim a church trial, which was much more lenient than royal courts.

Key Point: This era marked the shift from religious ordeals to jury trials, whilst church influence in legal matters significantly increased.
