Understanding Legislation in Health and Social Care
Legislation is simply the process of preparing and passing laws by local, state, or national governments. In health and social care, these laws act as your safety net, protecting both service users and care professionals.
The act of legislation creates new laws or sets of laws that Parliament has officially passed. Think of it as the rulebook that everyone in health and social care must follow to ensure quality, safety, and fairness.
Several key pieces of legislation shape Unit 2 of your studies. The Care Act 2014 focuses on people receiving social care and their carers, whilst the Data Protection Act 1998 keeps personal information safe. You'll also encounter the Equality Act 2010, which tackles discrimination, and the Mental Capacity Act 2005, protecting those who can't make decisions for themselves.
Other essential laws include the Children Act 2004 (safeguarding young people), the Human Rights Act 1998 (fundamental rights for everyone), and the Health and Safety at Work Act 1974 (workplace protection).
