The Crown Prosecution Service: Origins and Role

The Crown Prosecution Service was established in 1986 to solve a major problem - the police were investigating AND prosecuting crimes, which often led to bias and unfair treatment. This independent organisation now employs around 6,000 people across England and Wales, with over half being qualified lawyers.

The CPS has several key responsibilities that keep our justice system running smoothly. Their most important power came from the Criminal Justice Act 2003, which gave them the authority to decide whether to charge suspects in most cases (except minor traffic offences). They also advise police on potential prosecutions and prepare cases for court.

The Full Code Test is the CPS's essential decision-making tool, consisting of two parts: the evidential test and the public interest test. This system ensures every case is treated fairly and consistently before reaching court.

The evidential test asks a simple question: is there enough reliable, admissible evidence to secure a conviction? The CPS must consider what the defence might argue and whether evidence like hearsay (which isn't usually acceptable in court) would weaken the case. If this test fails, the case stops here.

Remember: Both tests must be passed for a prosecution to proceed - it's not enough to just have evidence or public interest alone.

The public interest test determines whether prosecuting someone actually serves the public good. Sometimes an out-of-court disposal might be better than a full trial. Key factors include the crime's severity, the suspect's age (especially if under 18), and the impact on the community.

The Abu Hamza case demonstrates what happens when the full code test isn't properly followed. Despite being convicted of serious terrorism offences in 2004, the evidence hadn't actually passed the evidential test initially. This case highlights why following proper procedures is crucial for maintaining justice system integrity.
